Welcome to Family Connection Hub. These Terms of Service ("Terms") govern your use of the Family Connection Hub mobile application ("App") operated by Family Connection Hub ("we," "our," or "us").
1. Description of Service
Family Connection Hub is a private family communication and memory-sharing application that allows family members to:
- Send encrypted messages, photos, and voice messages
- Share memories, traditions, recipes, and activities
- Track family goals, gratitude, and events
- Collaborate on to-do lists, meal plans, and lending libraries
- Preserve family history and fun facts
2. Account Registration
2.1 Eligibility
You must be at least 18 years old to create an account and manage a family group. Children under 18 may use the App under parental supervision with an account created by a parent or guardian.
2.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your password and family passphrase
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
2.3 Account Information
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
3. Family Groups
3.1 Creating a Family
When you create a family group, you become the initial administrator. You set the family passphrase that encrypts all family data.
3.2 Joining a Family
To join an existing family, you must receive the family passphrase from a current member. By joining, you agree to respect the privacy of other family members.
3.3 Administrator Responsibilities
Family administrators can:
- Invite and remove family members
- Delete family content (in Master Delete mode)
- Export family data
- Manage family settings
4. Acceptable Use
4.1 You Agree NOT to:
- Use the App for any unlawful purpose
- Share your family passphrase with non-family members
- Upload content that infringes on intellectual property rights
- Upload malicious code, viruses, or harmful content
- Attempt to gain unauthorized access to other accounts or systems
- Use the App to harass, abuse, or harm others
- Reverse engineer or attempt to extract source code
- Use automated systems or bots to access the App
- Resell or redistribute the App
4.2 Content Standards
All content you upload must:
- Be content you have the right to share
- Not contain illegal material
- Not violate the privacy rights of others outside your family
- Be appropriate for all ages within your family group
5. Your Content
5.1 Ownership
You retain ownership of all content you create and upload to the App. We do not claim ownership of your photos, messages, or other family content.
5.2 License to Us
By uploading content, you grant us a limited license to store, transmit, and display your content solely to provide the App's functionality to you and your family members. This license terminates when you delete your content or account.
5.3 Encrypted Content
Your content is encrypted before storage. We cannot read, access, or view your encrypted family content. You are solely responsible for maintaining access to your encryption passphrase.
6. Privacy
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
7. Third-Party Services
7.1 Firebase Services
The App uses Google Firebase for authentication, database, storage, and analytics. Your use of these services is also subject to Firebase Terms of Service.
7.2 Optional Integrations
The App may offer optional integrations (such as Google Calendar sync and Immich photo backup). These are provided "as is" and we are not responsible for third-party services you choose to connect. By connecting these integrations, you agree to the respective third-party terms of service (e.g., Google's Terms of Service for Google Calendar).
8. Intellectual Property
8.1 Our Rights
The App, including its design, features, and code, is owned by Family Connection Hub and protected by copyright, trademark, and other laws. You may not copy, modify, or distribute the App.
8.2 Feedback
If you provide suggestions or feedback about the App, you grant us the right to use that feedback without compensation or attribution.
9. Disclaimers
9.1 "As Is" Service
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9.2 No Guarantee
We do not guarantee that:
- The App will be available at all times or without interruption
- The App will be error-free or secure
- Any defects will be corrected
- Your data will never be lost (please maintain your own backups)
9.3 Data Loss
While we implement encryption and security measures, we are not responsible for data loss, corruption, or unauthorized access resulting from:
- Lost or forgotten passphrases
- Device loss or theft
- Third-party breaches beyond our control
- Your failure to maintain secure credentials
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (IF ANY)
- WE ARE NOT LIABLE FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL
11. Indemnification
You agree to indemnify and hold harmless Family Connection Hub, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Content you upload to the App
12. Termination
12.1 By You
You may delete your account at any time through the App settings. Upon deletion, you can choose how your content is handled (see Privacy Policy).
12.2 By Us
We may suspend or terminate your account if you:
- Violate these Terms
- Engage in fraudulent or illegal activity
- Create risk or legal exposure for us
12.3 Effect of Termination
Upon termination:
- Your right to use the App ends immediately
- We may delete your data according to our Privacy Policy
- Sections 5, 9, 10, 11, and 14 survive termination
13. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by:
- Updating the effective date at the top of this page
- Sending an in-app notification for significant changes
Continued use of the App after changes constitutes acceptance of the new Terms.
14. General Provisions
14.1 Governing Law
These Terms are governed by the laws of the United States, without regard to conflict of law principles.
14.2 Dispute Resolution
Any disputes arising from these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If unsuccessful, disputes shall be resolved through binding arbitration.
14.3 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Family Connection Hub regarding the App.
14.4 Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall continue in effect.
14.5 Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
14.6 Assignment
You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.
